STANDARD TERMS AND CONDITIONS OF SALE

1. Introduction

Welcome to Poseidon Cleaning Services ("we", "our", "us"). These Terms of Service ("Terms") govern all services provided by Poseidon Cleaning Services, including but not limited to kitchen exhaust system cleaning, mobile power washing, mobile auto detailing, carpet cleaning, window cleaning, house washing, and more (collectively, the "Services"). By scheduling, contracting, or using our Services, you ("Client", "you", "your") agree to these Terms. If you do not agree to these Terms, please refrain from using our Services.

 2. Services Provided

We offer a wide range of professional cleaning and detailing services, which include but are not limited to:

  • Kitchen Exhaust System Cleaning: Degreasing and cleaning of kitchen exhaust systems, ducts, hoods, and fans to ensure fire safety and operational efficiency.
  • Mobile Power Washing: Pressure washing services for driveways, patios, decks, sidewalks, siding, fences, and other outdoor surfaces.
  • Mobile Auto Detailing: Exterior and interior cleaning, waxing, polishing, upholstery cleaning, stain removal, and more for vehicles.
  • Carpet Cleaning: Steam or dry carpet cleaning, spot and stain removal, deodorizing, and upholstery cleaning for residential and commercial properties.
  • Window Cleaning: Interior and exterior window cleaning, screen cleaning, hard water stain removal, and skylight cleaning.
  • House Washing: Soft washing for delicate surfaces, power washing for tougher areas, mold, mildew, and algae removal, and more for residential and commercial properties.

The specific details of each service will be outlined in the service agreement, sales order or invoice.

3. Client Responsibilities

The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.

  • Access to Property: The Client is responsible for providing clear access to the service location at the scheduled time of service. This includes unlocking gates, doors, or windows, securing parking, and ensuring no obstructions prevent us from performing the Services.
  • Site Preparation: The Client is responsible for removing any fragile items, furniture, or personal belongings from the areas where Services are being performed. For vehicle detailing, the Client should remove personal items from the vehicle's interior.
  • Water and Power Supply: The Client must provide access to water and electricity where applicable unless otherwise arranged.
  • Pre-existing Conditions: The Client must inform us of any pre-existing damage, fragile areas, or conditions that may require special care. We are not liable for exacerbating pre-existing damage.

4. Scheduling and Cancellations

  • Booking: Appointments can be made through our website, phone, or email. Accurate information must be provided regarding the property, vehicle, or surface to be cleaned.
  • Cancellations and Rescheduling: Cancellations or rescheduling requests must be made at least 24 hours before the scheduled service. Cancellations made within 24 hours may be subject to a cancellation fee.
  • Weather Conditions: Services like house washing, window cleaning, and mobile auto detailing may be rescheduled due to inclement weather (e.g., heavy rain, strong winds). We will notify the Client to reschedule.

5. Service Limitations

  • Stain Removal Disclaimer: While we use industry-standard products and methods, we cannot guarantee the complete removal of all stains (e.g., rust, oil, bleach, pet stains). The effectiveness of our cleaning depends on the surface or material condition and the nature of the stain.
  • Surface Integrity: Some surfaces may be too fragile for pressure or soft washing. The Client must notify us of any such concerns. We are not responsible for damage to structurally weak or pre-damaged surfaces.

6. Health and Safety

  • Safe Work Environment: The Client must ensure the work environment is free from hazards, such as exposed wires, dangerous chemicals, or structural issues. We reserve the right to refuse service if the conditions are deemed unsafe.
  • Children and Pets: The Client is responsible for keeping children and pets away from the work area during and immediately after the service to ensure their safety and prevent interference with the work.

7. Payment Terms

  • Service Fees: The cost of the service will be detailed in the quote or invoice provided to the Client before the service.  We reserve the right to refuse any work that is not included in the original scope of services. Any additional work requested by the client beyond the agreed-upon scope maybe performed at our discretion an will be invoiced accordingly.
  • Payment Due: Payment is due upon completion of the service unless otherwise agreed upon. We accept all major credit cards, cash and bank transfers.
  • Late Payments: Invoices not paid within 15 days of service completion will incur a late fee of 2% per month, 24% per year. If a payment is still outstanding more than sixty (60) days after the payment due date, Poseidon Cleaning Services reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.

8. Warranty and Liability

  • Satisfaction Guarantee: We stand by the quality of our Services. If the Client is unsatisfied, they must notify us within 48 hours.  We will return to address any issues at no additional charge.
  • Limitation of Liability: We are not liable for damage resulting from pre-existing conditions, structural problems, improper installation, or fragile materials. Furthermore, we are not responsible for any damage caused by unsafe or unsuitable surfaces, improper client preparation, or environmental factors beyond our control.

9. Force Majeure

We shall not be liable for any failure to perform the Services due to events beyond our reasonable control, including but not limited to natural disasters, severe weather, accidents, or government actions.

10. Environmental Considerations

We strive to use environmentally friendly products and methods whenever possible. We comply with local regulations concerning water use, runoff, and waste disposal. Clients should inform us of any specific environmental restrictions related to their property.

11. Client Property and Third-Party Damage

  • Client Property: The Client is responsible for protecting valuable or fragile items located near the work area. We are not responsible for damage to items left in the work area unless caused by our negligence.
  • Third-Party Damage: We are not liable for any damage caused to neighboring properties during the service unless such damage is directly caused by our negligence.

12. Amendments and Modifications

We reserve the right to modify or update these Terms at any time. Significant changes will be communicated to the Client, and continued use of our Services implies acceptance of the revised Terms.

13. Termination of Service

We reserve the right to refuse or terminate service if the Client fails to comply with these Terms or if unsafe, unsanitary, or unsuitable conditions are present at the property.

14. Governing Law

These Terms of Service are governed by the laws of Ontario Canada. Any disputes arising from or related to these Terms shall be resolved in the courts of Ontario Canada.
